“The Living Trust Seminar” deals with foundational estate planning using living trusts, powers of attorney, advance health care directives, etc. (Detailed Description);
“The Retirement Plan Trust Seminar” deals with special planning that may be done for qualified retirement plans such as 401(k) and IRAs when they are inherited, including deferral of income taxation and asset protection (Detailed Description); and
The “Heggstad and Trust Modification Workshop” covers two common court petitions intended to solve the following problems (available for trusts where the decedent or the successor trustee was a resident of one of the following counties: Santa Clara, San Mateo, or Contra Costa):
Heggstad Petition: When someone with a trust is still alive but incapacitated, or dies owning a trust (i.e. a “decedent”), but some or all of the assets of the decedent were not properly titled into the trust ownership or payable to the trust after the decedent’s death. I will cover a quick and efficient method of transferring those loose assets into a decedent’s trust without going through the expensive and time-consuming Probate process.
Trust Modification Petition: A solution for older trusts that were drafted in the past and may no longer reflect the wishes of the original creator(s). This is especially the case for trusts drafted for married couples before the major change in the federal estate tax exclusion amount, making such trusts obsolete or even dangerous to the financial health of the family. Other situations may apply as well. Will also cover how to fix trusts after the death of the creator of the trust.
